Welcome to Roomoo.

These Terms of Use (“Terms”) govern your access to and use of roomoo.gr, including the services, listings, content and features made available through the website (“Roomoo”, the “Platform”). By accessing or using Roomoo, submitting a listing, or purchasing a service through the Platform, you agree to these Terms. If you do not agree with these Terms, you should not use the Platform.

About Roomoo

Roomoo is an online platform designed to help people advertise, discover and connect around rooms and other eligible spaces available to rent or share.
Roomoo enables property owners, landlords and authorised representatives (“Advertisers”) to present eligible spaces to people looking for accommodation (“Tenants”).
Roomoo reviews listings before publication according to its publishing standards and may provide additional services to Advertisers, including professional photography and video.
Roomoo is not the landlord or tenant and, unless expressly stated otherwise, does not act as an estate agent, property manager or representative of either party.
Roomoo is not a party to any tenancy, licence, occupancy or other rental agreement entered into between an Advertiser and a Tenant.
Eligibility

You must be at least 18 years old and have the legal capacity to enter into binding agreements to use Roomoo’s services.

By using the Platform, you agree to:

provide true, accurate and current information;
use Roomoo lawfully and in good faith;
comply with these Terms and applicable law; and
not use Roomoo in a fraudulent, misleading or abusive manner.

1. Advertising a space

Advertisers may submit rooms or other eligible spaces for consideration by Roomoo.

By submitting a listing, you confirm that:

you are the owner of the property or otherwise have the necessary authority to advertise and offer the space;
the information supplied is accurate and not misleading;
the photographs and videos supplied accurately represent the space;
you have the necessary rights or permissions to provide any photographs, videos or other materials submitted to Roomoo;
offering the space does not breach applicable law or any agreement or restriction that applies to the property; and
you will notify Roomoo promptly of material changes to the listing.

Roomoo may request additional information or documentation where reasonably necessary to review a listing.

Submitting a listing does not guarantee publication. Roomoo reserves the right to decline a listing that does not meet its publishing standards.

2. Listing information

Advertisers are responsible for ensuring that the information they provide is accurate, complete and current.

This may include, where applicable:

location;
type of space;
rent;
deposit;
bills and additional costs;
availability;
minimum stay;
occupancy;
amenities;
house-sharing arrangements;
photographs and videos;
property characteristics; and
other material conditions associated with renting the space.

Advertisers must not use photographs that materially misrepresent the property or deliberately omit information that would reasonably affect a prospective Tenant’s decision.

Advertisers should notify Roomoo when a space is no longer available.

3. Roomoo reviewed

Roomoo reviews listings before publication.

Listings that have completed Roomoo’s review process may display the “Roomoo reviewed” status.

The review is intended to improve the quality, clarity and reliability of information presented through the Platform.

Depending on the listing, Roomoo’s review may include consideration of the information supplied by the Advertiser, photographs or videos, pricing, availability, property details and other information relevant to publication.

However, “Roomoo reviewed” is not a guarantee or certification of a property, Advertiser or rental arrangement.

Unless Roomoo expressly states otherwise, the review does not constitute:

a structural or building survey;
a physical inspection;
a legal inspection or legal due diligence;
a safety certification;
a valuation;
a guarantee of ownership or legal title;
a financial or background check of an Advertiser;
verification of every statement made in a listing; or
a guarantee that a property is suitable for a particular person.

Tenants remain responsible for confirming information that is important to them before entering into an agreement or transferring money.

4. Listing services and payment

Certain services offered by Roomoo may require payment.

The applicable price, listing duration, included services, taxes and any other charges will be clearly presented before an Advertiser completes a purchase.

A purchase applies only to the service and period displayed at the time of purchase.

Unless expressly stated otherwise at the time of purchase, Roomoo listing services do not renew automatically.

If an Advertiser wishes to continue advertising after a listing period expires, a new listing period must be purchased.

Roomoo will not automatically charge an Advertiser for a subsequent listing period without their express agreement.

5. Commission and rental payments

Unless expressly stated otherwise, Roomoo does not charge commission on the rent agreed between an Advertiser and Tenant.
Rent, deposits, bills and other payments associated with the rental arrangement are agreed and handled directly between the Advertiser and Tenant.
Roomoo does not hold deposits or rent on behalf of either party and does not guarantee payments or obligations between users.

6. Expiry and availability

At the end of the applicable listing period, a listing may expire or cease to appear as actively available unless the Advertiser purchases another listing period.

If a space is rented or otherwise becomes unavailable before the listing period ends, the Advertiser should notify Roomoo.

Roomoo may mark the listing as occupied or unavailable or remove it from active search results.

Unless otherwise stated at the time of purchase, unused time remaining on a listing does not automatically carry over to another listing or listing period.

This does not affect any mandatory statutory rights available to consumers.

7. Cancellation and consumer rights

Where an Advertiser purchases a Roomoo service as a consumer, statutory rights under Greek and European Union consumer law may apply, including, where applicable, rights relating to distance contracts and withdrawal.
Where a consumer expressly requests that Roomoo begin providing a service before the expiry of an applicable withdrawal period, the consequences of that request and any amount that may become payable will be communicated as required by applicable law.
Nothing in these Terms limits or excludes rights that cannot lawfully be limited or excluded.
Any specific cancellation, withdrawal or refund information applicable to a purchased service will be presented during the purchase process or otherwise made available to the Advertiser.
Promotional offers

Roomoo may occasionally offer discounts, introductory offers, promotional codes or other incentives. Such promotions may be subject to additional conditions, including eligibility requirements, expiry dates and limits on use. Any specific conditions will be communicated with the relevant offer. Promotional offers cannot be exchanged for cash and cannot be combined unless expressly stated otherwise.

8. Photography, video and additional services

Roomoo may offer optional services such as professional photography, video production or other property presentation services.
The scope, availability, price and applicable conditions of these services will be presented before purchase.
Purchasing an additional service does not guarantee a particular number of enquiries, a successful rental or a particular rental price.
Any rights granted to the Advertiser to use photographs, video or other material produced as part of these services will be communicated as part of the relevant service.

9. Tenant responsibilities and renting safely

Roomoo helps prospective Tenants discover spaces but does not make rental decisions on their behalf.

Before entering into an agreement or transferring money, Tenants should take reasonable steps to satisfy themselves that the property, Advertiser and proposed rental arrangement are suitable.

This may include:

confirming the identity and authority of the Advertiser;
viewing the property where reasonably possible;
confirming the address and material property details;
confirming rent, deposit, bills and additional costs;
confirming availability and occupancy arrangements;
understanding the terms of the proposed rental agreement;
requesting an appropriate written agreement; and
avoiding transferring money where the circumstances appear suspicious.

A listing appearing on Roomoo, including one displaying “Roomoo reviewed”, should not replace a Tenant’s own reasonable checks.

10. Direct communication between users

Roomoo may enable prospective Tenants to contact Advertisers directly using contact details or other contact functionality provided through a listing.

Unless expressly stated otherwise, these communications take place directly between the Tenant and Advertiser.

Users are responsible for their communications, representations and arrangements with one another.

Users must not use contact information obtained through Roomoo for spam, unsolicited marketing, harassment, data harvesting or purposes unrelated to a genuine enquiry about the advertised space.

11. Rental agreements

Any tenancy, licence, occupancy agreement or other arrangement concerning a listed space is entered into directly between the Advertiser and Tenant.

Roomoo does not determine the final terms of that agreement and is not responsible for negotiating it on behalf of either party.

Advertisers and Tenants are responsible for ensuring that their agreement and conduct comply with applicable law.

Roomoo strongly recommends that appropriate rental arrangements are documented in writing.

12. Permitted use

Roomoo may only be used for lawful purposes consistent with the purpose of the Platform.

You must not:

publish or provide false or misleading information;
impersonate another person or organisation;
advertise a property without appropriate authority;
use Roomoo for fraud or deception;
harass, threaten or abuse another person;
send spam or unsolicited commercial communications;
collect or harvest users’ personal information without lawful authority;
systematically extract landlord or listing information;
use bots, crawlers, scrapers or other automated systems to access or extract information from Roomoo without written permission;
interfere with the security or operation of the Platform;
attempt to gain unauthorised access to Roomoo or another user’s information;
introduce malicious software or code;
infringe intellectual-property or privacy rights; or
use Roomoo for an unlawful purpose.

13. Prohibited listings and content

Roomoo may refuse to publish, suspend or remove content or listings that:

are false or materially misleading;
appear fraudulent;
use photographs that do not correspond to the advertised space;
are submitted without appropriate authority;
infringe third-party rights;
contain unlawful, defamatory, abusive, threatening, discriminatory, pornographic or otherwise inappropriate content;
present a material safety concern;
promote unlawful discrimination;
attempt to misuse Roomoo or its users; or
otherwise fail to comply with these Terms or Roomoo’s publishing standards.

Where required by applicable law, Roomoo will provide appropriate information regarding content moderation decisions and available means of redress.

14. Reporting a listing or concern

If you believe that a listing, Advertiser, communication or other content on Roomoo is fraudulent, unlawful, misleading, unsafe or otherwise breaches these Terms, you may report it to:

Roomoo may review the information provided and take appropriate action, including requesting further information, correcting or removing content, suspending publication or cooperating with competent authorities where required by law.

15. Suspension or removal

Roomoo may suspend, reject, restrict or remove a listing or access to its services where reasonably necessary, including where:

these Terms have been breached;
information appears materially false or misleading;
Roomoo reasonably suspects fraud or unlawful activity;
the Advertiser cannot demonstrate appropriate authority to advertise the property;
the listing creates a material risk to users;
required information is not provided; or
removal is required by law or a competent authority.

Any rights available under applicable law regarding such decisions remain unaffected.

16. No guarantee of results

Roomoo does not guarantee that publishing a listing will result in enquiries, viewings, a tenancy or any particular financial return.

Roomoo also does not guarantee that a prospective Tenant who contacts an Advertiser will ultimately rent the space or comply with any subsequent agreement.

17. Intellectual property

The Roomoo name, logo, visual identity, website design and original content made available through the Platform are owned by Roomoo or its licensors and are protected by applicable intellectual-property laws.

They may not be copied, reproduced, modified, redistributed or commercially exploited without permission, except where permitted by law.

Advertisers retain ownership of materials they submit where they hold the relevant rights.

By providing photographs, descriptions, videos or other materials for a listing, the Advertiser grants Roomoo a non-exclusive licence to store, reproduce, resize, format, display and otherwise use those materials as reasonably necessary to create, operate and promote the listing and Roomoo’s services.

The Advertiser confirms that they have the necessary rights to grant this permission.

18. Third-party service providers

Roomoo may use third-party providers to support the operation of the Platform and its services, including providers of:

website hosting;
cloud infrastructure;
email;
security;
analytics;
payment processing;
maps or location services; and
other technical or professional services.

The processing of personal information involving such providers is addressed in the Roomoo Privacy Policy where applicable.

19. Third-party websites and services

Roomoo may contain links to or integrations with websites and services operated by third parties.

Roomoo does not control third-party websites and is not responsible for their content, availability, security, privacy practices or terms.

Users should review the relevant terms and privacy information when using third-party services.

20. Availability of the Platform

Roomoo will make reasonable efforts to maintain the availability and security of the Platform.

However, uninterrupted or error-free access cannot be guaranteed.

Roomoo may temporarily restrict access for maintenance, updates, security, technical issues or circumstances outside its reasonable control.

Where reasonably possible, Roomoo will seek to minimise disruption to active paid services.

21. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Subject to applicable law, Roomoo is not responsible for agreements, representations, payments or disputes arising directly between Advertisers and Tenants, except to the extent that liability arises from Roomoo’s own acts or omissions and cannot lawfully be excluded.

Roomoo is not responsible for inaccurate information supplied by an Advertiser where Roomoo could not reasonably have identified the inaccuracy through the review process it expressly undertakes.

Roomoo does not guarantee the conduct, financial position, reliability or future actions of an Advertiser or Tenant.

Any exclusion or limitation of liability contained in these Terms applies only to the extent permitted by applicable law.

22. Privacy and personal data

Roomoo processes personal data in accordance with its Privacy Policy and applicable data-protection law.

The Privacy Policy explains what information Roomoo collects, why it is processed, how it may be shared and retained, and the rights available to individuals.

23. Changes to these Terms

Roomoo may update these Terms from time to time to reflect changes to its services, business operations or applicable law.

The date of the latest version will be displayed at the top of this page.

Where a change materially affects an existing purchased service, Roomoo will provide any notice required by applicable law.

Changes will not retrospectively remove mandatory statutory rights.

24. Governing law and jurisdiction

These Terms are governed by the laws of Greece.

Any dispute arising in connection with these Terms or the use of Roomoo will be subject to the jurisdiction of the competent Greek courts, except where applicable law provides otherwise.

Nothing in these Terms deprives a consumer of mandatory protections or rights available under applicable Greek or European Union law.

25. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.

The affected provision will apply to the greatest extent permitted by law.

26. No waiver

If Roomoo does not immediately exercise a right or remedy under these Terms, this does not mean that Roomoo has waived that right or remedy.
